Trying to dissect one individual for how non-binary they actually are in the moment creates impossible distinctions and requires a rubric of exclusion antithetical to being non-binary. We are already beneath a crushing level of metaphysical skeptism as is that refining it can only be to our pain.
Enbyphobia (or non-binaryphobia) and enby erasure is something that exists even in trans circles. Some binary trans people look at non binary trans identities as being less respectable often due to the external forces of society looking to discredit trans people as a whole finding an easier target in the branch that requires more to understand. Solidarity is the most effective means of consolidation of power, something we have learned again and again in the history in the fight for civil rights but those lessons need to be passed on. These discussions push a lot of public declarations of a sort of pride at the ignorance one has in regard to non-binary identities into the fore which as a non-binary person is emotionally difficult to deal with so I advise allies arm yourself with knowledge, debate skills and compassion. You may be needed to help bring up to date those who would wash their hands and proclaim that they "just don't get it" as on the whole just having that ignorance aired can hurt because it is at it's root a different way of saying "I do not care." and that comfort with indifference can be callous.
I believe the only way to proceed is to treat the shooter as unskeptically as we can as non-binary. Conceeding that doesn't mean what they did wasn't a hate crime. It does mean there's a larger burden of context nessisary to explain to jurors which could be a ploy and a true difficulty in selecting "non-biased" jurors as those who understand and respect non-binary identities also tend to have strong feelings towards hate towards our communities. However using the actions of this individual to perpetrate more trans and enbyphobia is not the right call. This case will likely set some high profile precedents for how the justice system interacts with non-binary identities so specific care should be taken not to make additional targets of the community this individual could be trying to harm in a secondary fashion.
It is right to be angry. To feel whatever comes to mind but to weigh ones desire for retributive harm with caution. It is easy to fire the arrow over the house and wound your siblings.
Edit : I believe I need to do a TD;LR to elucidate my point here as I have been getting some feedback that this is being misconstrued as a defense of Anderson. This is not my intention. To be clear : Anderson Lee Aldrich was caught redhanded doing an explicitly malicious and evil criminal act. I personally believe they deserve to be eaten alive by rats. HOWEVER
TD;LR The American Justice System, a powerful and inflexible beaurcratic entity that once it establishes precedent guides itself by the past handling of cases , now may be in the position of attempting to prove or disprove whether someone is Non-binary or not. This precedent that is set by this garbage human being might one day govern the outcome of trials where an individual may be actually innocent. I have concerns.
